Here are the phases of Land Development Services:
LAND DEVELOPMENT SERVICES
• TRUST AGREEMENT
The Agreement between the developer and the title company to enable you to use an Assurance Agreement and benefit from all title company services.
All documents presented to the trust must have beneficiary approval for signature.
• ENGINEERING
Interaction with engineer through the entire process of creating a new subdivision plat.
• PLATTING
The Title Department will review the plat before submitting it to the municipality for recording.
• TITLE WORK – FREE TO TRUST CUSTOMERS
All title work required to plat the subdivision is done as a courtesy to our customers.
• ASSURANCE AGREEMENT
Subdivision improvement guaranty to the municipality. The use of this form takes the place of posting a bond or letter of credit with less out of pocket expense to the developer.
• CC&R’S
Subdivision restrictions which allow the Homeowners Association to enforce the Rules and Regulations for each specific community. This document is prepared by the developer or their agent.
• EASEMENT SEARCH
The Title Department can research easements which affect your community.
• CAGRD
Central Arizona Groundwater Replenishment District. This is a requirement to get a Public Report in order to sell lots. The department will aid in getting this document for the developer.
• PUBLIC REPORT
This report is required when selling more than 5 lots. The trust department handles all aspects of compiling the paperwork and filing in the questionnaire in order to secure the Public Report for the developer.
• ASSURANCE AGREEMENT RELEASE OF LOTS
The Trust Department works with each municipality and engineer in order to gain a partial release and/or full release of the. Assurance Agreement, which is required before title to each lot can transfer to the new buyer.
• MAINTAIN LOT CONTROL
Lot controls of sold and released lots are maintained to keep the developer advised of what remains in each subdivision.
• DEED COMMON AREAS TO HOA
Prepare documents necessary to transfer title to the Homeowners Association, for the Common Areas, will be handled by the Trust Department upon completion and acceptance, by the municipality, of the improvements.
• MONITOR SALES AND WORK WITH ESCROW
The Trust Department works with escrow from the beginning of the sale of individual lots to the completion of the sale to gain all items necessary to transfer title to the new buyer.
• MULTI-BENEFICIARY OWNERSHIP OF LAND
This trust allows several entities to come together in one trust, as owners of land, with their beneficial interest reflecting their investment in the land.
